ERISA compliance
Last updated: October 9, 2026
This page explains how the federal benefits law, ERISA, applies to the plans we administer. It is general information, not legal advice.
CHOICE Arrangement
A CHOICE Arrangement is an individual coverage health reimbursement arrangement (ICHRA). It is a group health plan under ERISA.
- The employer is the plan sponsor and the plan administrator. The employer keeps those roles.
- Enough! Health Administrators provides administration services under a written service agreement.
- Every plan gets a plan document and a summary plan description. Employees get the required notice at least 90 days before the plan year starts. A plan set up less than 120 days before its start date gives notice by the first day it takes effect.
- The individual health plans employees buy are not part of the employer's ERISA plan when the employer does not select, endorse or pay for a particular plan. Employees choose any qualifying plan.
- Employee coverage details are kept private. The employer sees spending in total, not which employee holds which policy.
QSEHRA
A QSEHRA is for employers with fewer than 50 full-time employees and no group health plan. Employees get a written notice at least 90 days before the plan year.
Plan Enough! self-funded plans
Self-funded group health plans are ERISA plans. The employer is the plan sponsor and fiduciary. Enough! Health Administrators acts as third-party administrator under a written agreement.
Records and documents
Plan documents, summaries and notices are kept for at least six years. Employees can ask their employer for a copy at any time.
